Release & Waiver

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF THE RISK, INDEMNITY, AND PARENTAL CONSENT AGREEMENT

This is a Release and Waiver of Liability, Assumption of the Risk, Indemnity, and Parental Consent Agreement (“Release & Waiver”), which provides a limitation of liability with respect to persons who participate in any purchase and/or use of supplements through the online store (“the online supplement store”) provided by Water’s Edge Wellness.

I understand that this form is a contract with legal consequences. I hereby freely agree to make the following contractual representation and agreements:

I understand that the use of any supplements purchased from this online store may result in adverse effects. I certify that, to the best of my knowledge, I have no physical or internal condition which will be aggravated by use of these supplements purchased in the online store. 

I understand and acknowledge that the persons or institutions associated with the online supplement store, or their agents, have requested a wellness consultation before purchase and use of supplement, to which I have personally declined. I further understand and acknowledge that none of the persons or institutions associated with the online supplement store, or their agents, are responsible for the conditions which I may encounter after purchase and use of supplements through the online store. I have not relied upon any representation that the supplements are safe or in any way free of risk for my use.

I expressly acknowledge and realize the inherent risks and dangers associated with this or any purchase and/or use of supplements through the online store, and the possibility of serious physical and/or mental trauma or injury or death that may result from ingestion. I FULLY ASSUME ANY DANGERS, RISKS, AND SOCIAL AND ECONOMIC LOSSES ASSOCIATED WITH SUCH PARTICIPATION INCLUDING, by way of example, and not limitation, the following: risks and dangers caused by my own actions or inaction and the possibility of serious physical and/or mental trauma or injury.

For myself, my heirs, executors, administrators, legal representatives, assignees, and successors in interest (collectively “Successors”) I HEREBY WAIVE, RELEASE, DISCHARGE, HOLD HARMLESS, AND PROMISE TO INDEMNIFY AND NOT TO SUE the owners of the online supplement store found on Water’s Edge Wellness website FROM ANY and all rights and claims, including claims arising from any and all negligence, which I have or which may hereafter accrue to me and from any and all damages which may be sustained by me directly or indirectly in connection with, or arising out of, my participation in purchase and use of supplements purchased in the online store.

I agree it is my sole responsibility to be familiar with the supplements and any special contraindications, including, but not limited to the mixture of alcohol, drugs, and/or other medications and supplements.

I agree, for myself and my successors, that the above representations are contractually binding, are not mere recitals, and may not be modified orally. I, the undersigned, on behalf of myself and/or my child(ren)/ward/family member(s) named herein, have read this contract, fully understand the terms of same, and understand that I, of behalf of myself and/or my child(ren)/ward/family member(s), have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of any liability to the greatest extent allowed by law.
